I had a design up for several months. I checked Trademark/Copyright prior to upload and was good to go.
The phrase quickly caught on and in addition to numerous pixel by pixel design theft, other variations popped up along the way. My design had an under 50K rank and on a whim, while checking another phrase, saw that copyright was filed within the past month for my design phrase in question.
So, I pulled it/deleted from Merch to be safe.
My question is this for Merch -- had the new copyright owner filed a report against my design, what is Amazon's Stance on this? Would the date of submission VS date of copyright or trademark filing come into play to avoid a Violation to my account?
Would I have been allowed to maintain my design on Merch or if not (which is understandable) at least excused from a Violation based on dates of submission? Account health is important to the majority of us.
I am new to POD -- is it expected to constantly check for copyright filings after designs have been created?
I get that Merch is so very new and not all scenarios have been considered yet but I fear this will logically occur again and as most of us run other businesses this may be a task that needs to be handled by hiring a VA to check daily.
Just curious to know where Merch stands when it comes to a situation like this
